This Terms and Conditions document (together with the Delivery Options and Returns Policy pages on this site) governs the use of the luggage.co.nz Online Service (the Service) including shopping and participation in promotions run by luggage.co.nz. By using the Service, you agree to be bound by this document (and those pages). You can access this document at any time from the bottom of any page of the site.
SHOPPING TERMS AND CONDITIONS
PURCHASING FROM LUGGAGE.CO.NZ
luggage.co.nz gives customers convenient, quick, easy and secure shopping.
Products displayed on the site shopping areas can be purchased using a secure online Mastercard, Visa and PayPal transaction facility. Customers can be confident that all of their details are protected by the latest security mechanisms and are used only for purposes of the transaction fulfilment. You will be asked to register as a member of luggage.co.nz. Apart from the many member benefits, including receiving regular emails containing special deals, your shopping address details will be filed saving you the effort of entering these details each time you checkout.
Products will be supplied by EverMe Limited (T/A luggage.co.nz). Products will be shipped to you from New Zealand. After placing an order, you will receive an email acknowledging receipt of your order and confirming which company will be the supplier. This does not mean that your order has been accepted. Your order constitutes an offer to the supplier to buy the product. All orders are subject to acceptance by the supplier, and the supplier will confirm such acceptance by sending you an email that confirms that the product has been dispatched. The contract between the supplier and you will only be formed at that time.
The contract relates to those products whose dispatch has been confirmed by the supplier. The supplier will not be obliged to supply any other product which may have been part of your order until the dispatch of those products has been confirmed. Your credit card or PayPal payment will be processed by the supplier at the time your products are dispatched.
The products will be at your risk from the time of delivery. Ownership of the products will only pass to you when the supplier receives full payment of all sums due in respect of the products, including delivery charges.
When purchasing off this site, the name that will appear on your statement will be "EverMe Limited"
All prices and delivery charges on our site are in New Zealand Dollars (NZ$). We reserve the right to alter prices and delivery charges for any reason at any time. If this should happen after you have placed an order, we will contact you prior to processing it.
The supplier will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under its contract with you that is caused by an event outside its reasonable control.
We use the secure Hosted Payment page solution from eWay (www.eway.com.au) to process online orders. Customers can see their cards being authorised in real time, all in an SSL secure environment. The Hosted Payment page enables us to offer customers a safe and speedy online shopping experience.
eWay complies with the PCI DSS (Payment Card Industry Data Security Standard). This is a set of rules created by the Payment Card Industry Security Standards Council to encourage the broad adoption of consistent data security measures around the world.
These rules apply to anyone who is storing, processing or transmitting credit card data. When we transmit sensitive information (such as a credit card number) over the internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Credit card details stored on site are encrypted using 168bit 3DES encryption. DPS is also certified AIS compliant.
eWAY® is externally audited by Stratsec (QSA) every year, who have verified us as tier-one PCI DSS compliant. This means we adhere to the highest security standards set by Visa and MasterCard.

USE OF THE SERVICE BY YOU
Your right to use the Service is personal to you. You may not authorise others to use the Service, and you are responsible for all of your own use of the Service.

The Service's content, information and advice is free of charge (unless otherwise stipulated). However you are responsible for your own network and connection charges.
Other than connecting to luggage.co.nz servers by HTTP requests using a web browser, you may not attempt to gain access to luggage.co.nz servers by any means - including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Service or otherwise.
You agree not to disrupt, modify or interfere with the Service or its associated software, hardware and servers in any way and you agree not to impede or interfere with others' use of the Service. You further agree not to alter or tamper with any information or materials on, or associated with, luggage.co.nz and/or the Service.

EverMe Limited is the owner of the copyright and other intellectual property rights in the material contained in the Service or is permitted by the owner to use such material. No permission is given in respect of the use of such mark or rights, and such use may constitute an infringement of the owner's rights.
EverMe Limited is a New Zealand owned company, registered with the New Zealand Companies Office, registration number 3790119.
EverMe will over time provide content and information which children may find interesting and may wish to access. However, no one under the age of 13 years is allowed to provide any personal information.
This Service provides general information about EverMe Limited and the products and services they offer. The information contained in the Service has been prepared solely for the purpose of providing information about EverMe and the services and products they offer. EverMe reserves the right to change, delete or move any of the material on the Service at any time without notice.
